Terms of Service

Last updated: 15 September 2026

This version was published on 15 September 2026 and withdrawn on 16 September 2026 while it is revised. It never took effect for accounts that existed before it was published. Accounts created while it was the current version accepted it at signup; the version in force for every account is now the one at foundermail.mx/terms, which asks less of you. The revision will be emailed to every account owner at least 30 days before it takes effect.

1. Agreement

These terms are a contract between you and Webco S.r.l.s., Montorio al Vomano (TE), Italy ("FounderMail", "we"). By creating an account or using the service you accept them. If you use the service on behalf of a company, you confirm you may bind it, and "you" means the company.

2. The service

FounderMail hosts email for domains you own. The service consists of mail servers that receive and send mail for your domains and serve it over IMAP and SMTP, a web dashboard that presents that mail grouped by correspondent with tools for a team to work on it, a REST API and an MCP server that read mail and write drafts, and forwarders, webhooks and templates that act on incoming mail. What each plan includes is set out at foundermail.mx/#pricing and in the documentation.

The service is business email. It is not a bulk, marketing or transactional sending platform, and the monthly allowances are sized accordingly.

3. Your account

  • You must be at least 18 years old.
  • You must give accurate information and keep it current.
  • You are responsible for everything done with your account, your API keys and your mailboxes' passwords, and for keeping them secret. Tell us at once if you believe any of them has been compromised.
  • You are responsible for the people you invite to your workspace and for what they do in it.

4. Domains

  • You may add only domains you own or are authorised to manage. Ownership is verified by a DNS record; until it is verified, a domain receives no mail and may be claimed by another account that proves ownership first.
  • You are responsible for your domain's DNS. We publish what records are needed and check them; we cannot change them for you unless you use the Cloudflare setup with a token you provide.
  • We may suspend a domain, or its ability to send, if it is used in breach of these terms or damages the deliverability of the service for others.

5. Acceptable use

You agree not to use the service to:

  • send unsolicited bulk email, or any email the recipient has not agreed to receive where the law requires agreement;
  • send automated or bulk outreach to people who have not asked to hear from you, including through sequence or mail-merge tools, automated follow-up cadences, or bought or scraped lists;
  • use warm-up services, engagement networks, or any tool that sends, opens or answers mail automatically to build a sending reputation;
  • spread sending across mailboxes, domains or accounts to get around a limit, a pause or a refusal;
  • send phishing, malware, or messages that impersonate another person or organisation;
  • receive, store or send content that is illegal, or that infringes another person's rights;
  • harass, threaten or defraud anyone;
  • probe, overload or interfere with the service or others' use of it, or attempt to access another workspace's data;
  • resell the service or offer mailboxes to third parties as your own service without our written agreement.

Outbound access. A domain may reply to addresses that have written to it. To send to other addresses you request outbound access for that domain, describing what you intend to send. We may grant, refuse or later withdraw it at our discretion, and we withdraw it from domains used for bulk mail, for any use this section forbids, or that generate complaints. Replies continue to work.

How we watch sending. Every customer's mail depends on the same sending reputation, so we measure each domain's sending from delivery metadata: how many people it writes to, how many of them are new to your workspace, how many write back, and the bounces and complaints our delivery provider reports. We do not read your messages to do this. When those measures cross our limits, or when a recipient complains, outbound access for the domain is paused automatically. An address that hard-bounces is refused for every account, and an address that complains is refused for the account it complained about. A domain paused automatically may ask for outbound access again after 7 days.

We may suspend or terminate an account that breaches this section, immediately and without notice where the breach is serious or ongoing.

6. Plans, billing and changes

  • The plans are Free, Pro and Scale. Prices are in US dollars and are shown at foundermail.mx/#pricing; a year is billed at the yearly price shown there, which is less than twelve months.
  • Paid plans are billed in advance by card through Stripe, monthly or yearly. Upgrades are charged when made and take effect immediately. Downgrades, including to Free, take effect at the end of the paid period.
  • Fees are non-refundable except where the law requires otherwise.
  • Prices shown exclude taxes. Where VAT or a similar tax applies it is added at checkout, or you are responsible for it.
  • We may change prices with at least 30 days' notice by email to the account owner. A change applies from your next billing period after the notice.
  • If a payment fails we retry it for up to 30 days, after which the workspace falls to the Free plan and its limits.

7. Limits

Each plan has limits on messages received and sent per month, new recipients per day (people who have never written to your workspace), storage, retention, team members and request rates, published at the pricing page and in the documentation. When a limit is reached the service behaves as documented: incoming mail beyond the received allowance is refused with a permanent error so that the sender is informed, sending beyond the sent allowance or to more new recipients in a day than the plan allows is refused, storage beyond the pool refuses uploads, and mail older than the plan's retention is deleted. Junk mail does not count toward the allowances. We may apply temporary rate limits to protect the service.

8. Your data

  • The mail in your mailboxes and the data in your workspace are yours. You grant us the licence needed to store, process, display, index, forward and transmit them in order to provide the service, and for no other purpose.
  • You can export your mail at any time over IMAP. We do not hold it hostage: point your MX record elsewhere and copy your mail out, at any time, on any plan.
  • Our handling of personal data is described in the Privacy Policy, which forms part of these terms. Where you are a controller of personal data in the mail we host for you, we act as your processor and process it only on your instructions as expressed through the service.
  • You are responsible for having the right to receive, store and send the mail your mailboxes handle.

9. API and MCP server

Access to the REST API and MCP server is by API key on plans that include them. You must keep keys secret, respect the documented rate limits, and not attempt to circumvent the documented boundaries of the API. We may change the API with reasonable notice, and may withdraw a version after a deprecation period.

10. Availability and changes to the service

We aim to keep the service available at all times but do not guarantee it. We may perform maintenance, with notice where practical, and may change or discontinue features with reasonable notice. Incoming mail refused during an outage is retried by the sending server in the normal way; we cannot guarantee delivery of mail that the sending server abandons.

11. Intellectual property

The service, its software, design and content are ours or our licensors'. These terms give you the right to use the service; they do not transfer any of that to you. You may not copy, modify, or reverse engineer the service except as the law permits.

12. Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY OR ERROR-FREE, OR THAT MAIL WILL BE DELIVERED OR RECEIVED WITHOUT LOSS OR DELAY.

13. Limitation of liability

TO THE EXTENT THE LAW ALLOWS, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA OR GOODWILL, ARISING FROM THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE FEES YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM. Nothing in these terms limits liability that cannot be limited by law, including for fraud, gross negligence, or death or personal injury caused by negligence, or the mandatory rights of consumers.

14. Indemnity

If you use the service for business, you will defend and indemnify us against claims, losses and reasonable costs arising from your breach of these terms, your mail, or your breach of another person's rights or of the law.

15. Termination

  • You may stop using the service at any time. Downgrade to Free to end payments, or ask us to delete the account.
  • We may suspend or terminate your account for breach of these terms, for non-payment, or if we discontinue the service, in the last case with at least 60 days' notice.
  • On termination your access ends. Unless we terminated for breach, you have 30 days to export your mail over IMAP before the workspace is deleted; if we terminated for breach we may delete it sooner where the law allows.

16. Governing law

These terms are governed by the law of Italy. Disputes are subject to the jurisdiction of the Italian courts, without prejudice to any mandatory consumer protection or jurisdiction rules of the country where you live.

17. Changes to these terms

We may change these terms. For material changes we give at least 30 days' notice by email to the account owner before they take effect; continuing to use the service after that is acceptance. The current version is always at foundermail.mx/terms with its date.
